Below is an explanation of how Scandlines processes data that it receives in the context of recruiting processes:
In connection with your employment (or application for employment) at either Scandlines Deutschland GmbH, Scandlines Bordershop Rostock GmbH or Scandlines Bordershop Puttgarden GmbH, which all belong to the Scandlines Group and which share the business address of Bäckerbreitergang 75, 20355 Hamburg, Germany (collectively referred to hereinbelow as “Scandlines”), it will be necessary for Scandlines to collect personal data relating to you and to process such data in both digital and manual fashion, including data associated with one or several personality tests and cognitive tests that you may have taken. In this context, Scandlines will be responsible for your personal data (as the “data controller”).
Which personal data relating to you will Scandlines process in connection with recruiting processes and any personality tests or cognitive tests you have completed?
The personal data that Scandlines will collect and process in connection with your application and/or employment, and as the consequence of any personality or cognitive tests you have taken, include the following:
Providing this information is not mandatory. However, your failure to provide these data may make it impossible for Scandlines to take a positive hiring decision.
For which purposes will Scandlines process your personal data?
The collection and processing of personal data by Scandlines will serve the following purposes:
Scandlines will use your personal data so as to be able to evaluate you as a potential candidate and to decide whether you should be offered employment at Scandlines.
The processing of your personal data by Scandlines is necessary in order to be able to decide whether to enter into an employment relationship, and thus is justified pursuant to Article 6 paragraph 1 lit. b) of the General Data Protection Regulation (GDPR), respectively Article 88 of said Regulation read in conjunction with Section 26 paragraph 1 sentence 1 of the Bundesdatenschutzgesetz (BDSG, German Federal Data Protection Act).
Will your personal data be transmitted to others?
Scandlines will not transmit your personal data to any third parties, except for companies within the Scandlines Group and IT service providers whom we have contractually commissioned to process your personal data on our behalf and in accordance with our instructions. Insofar as your personal data are transferred to IT service providers outside the EU, we hereby assure you that said providers warrant the necessary and appropriate safeguards for the protection of your personal data. Your personal data will be transmitted to companies within the Scandlines Group or to IT service providers only if this is necessary to fulfill the purpose or purposes for which the personal data were collected. Scandlines uses a personality test supplied by the provider The Predictive Index (http://www.predictiveindex.com), whose privacy policy is available here: http://www.predictiveindex.com/privacy. If you ask us to erase or correct said data, then this will also entail the erasure or correction of the data that have been stored at The Predictive Index as a result of the test(s) which you have taken.
How long will Scandlines store your personal data?
If you are not hired by Scandlines, then Scandlines will store your personal data for a period of six months, reckoned as of the date on which the data were originally communicated. If you are hired by Scandlines, then Scandlines will store your personal data, on the basis of the relevant statutory obligations to maintain records, for the duration of the employment relationship – and possibly also thereafter, insofar as statutory archiving obligations apply or archiving becomes necessary in individual cases (e.g. in the event of a legal dispute).
What are your rights?
You have the right to at any time request information about the personal data relating to you that are being stored, as well as about the purposes for which the data are being processed, the duration of their storage, the rights existing in this context, the source of the data and the recipients of the data, as well as the right to request that the personal data be corrected or that the processing of said data be restricted or that they be erased, e.g. if the data were processed in an incorrect, misleading or otherwise unlawful manner. You also have the right to request a copy – in a structured, commonly used, and machine-readable format – of personal data relating to you which you yourself have provided to Scandlines, or data regarding you that are otherwise being stored by Scandlines, but only to the extent that said data do not contain any information about third parties,
In addition, you may object to the processing of your personal data in certain cases defined by law.
Insofar as Scandlines has collected or processed data relating to you on the basis of a declaration of consent, you may revoke this consent at any time with future effect without having to state grounds. Note that Scandlines may in this case still be legally entitled to process your personal data on the basis of some other statutory rule permitting such processing.
If you are not satisfied with the way your personal data are being processed by Scandlines, you may lodge a complaint with Scandlines and/or with a competent regulatory authority.
